4) Accounts

You are responsible for safeguarding credentials and all activity under your account. Notify us of unauthorized use immediately.

5) Acceptable Use & Messaging Compliance

No unlawful, abusive, deceptive, or spam activity.
Comply with TCPA, CTIA, CAN-SPAM, and carrier rules.
Only message recipients who have given express consent.
Include opt-out instructions (e.g., “Reply STOP to unsubscribe; HELP for help”). Honor opt-outs promptly.
No selling of personal data or contact lists.

Violations may lead to suspension or termination.

6) Payments & Renewals

Paid plans auto-renew unless canceled before renewal. Fees are billed in USD. Taxes may apply. No refunds for partial periods unless required by law.

7) Intellectual Property

All content and software are owned or licensed by Next Gen AI and protected by IP laws. You may not copy, modify, or distribute without permission.

8) Third-Party Services

Integrations (e.g., Google, Meta, Twilio) are provided by third parties. Their terms and privacy policies apply.

9) Termination

We may suspend or terminate access for any breach of these Terms or applicable law.

10) Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind.

11) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.

12) Indemnification

You agree to indemnify and hold harmless Next Gen AI and its affiliates from claims arising out of your use of the Services or violation of these Terms.

13) Privacy

14) Changes to Terms

We may update these Terms; the Effective Date will reflect the latest version. Continued use constitutes acceptance.

15) Governing Law & Venue

These Terms are governed by Illinois law. Exclusive venue: state or federal courts in Cook County, Illinois.
